This agreement represents payment for music, film and photo services. A deposit payment is due at time of contract receipt. A deposit of $2500.00 for this event should be made payable to “Lovesick.” Remaining balance is due 14 days prior to event date. No travel fees will be added if event is within designated travel areas as listed in Terms and Policies. All deposits or monies paid for services will be fully refunded to client if client cancels event at least 120 days prior to event date. The client will forfeit all monies if the client cancels this contract less than 120 days prior to the event date. Services provided beyond the stated end time will result in additional charges at a rate of $350.00 per half hour. *

The following terms and conditions apply to this agreement: *

• Lovesick shall have access to the event facility at least one hour before the music start time to set up and test equipment. • Lovesick will provide event coverage for the agreed upon start and end time. Times may be adjusted by the Client closer to the event date as noted in forthcoming Event Details form. • The Client shall provide one six-foot table (covered to match guest tables, if applicable) and two (2) nearby electrical outlets at the primary setup location. • Lovesick shall execute this Agreement as an independent contractor and not as an employee of the Client. • In the unlikely event that time is lost due to equipment malfunction, Lovesick will refund cost corresponding to lost time. This is the extent of Lovesick's liability. • Lovesick will not be obligated to continue services during inclement weather in an outdoor location. • Lovesick will make reasonable efforts to provide an audio feed for the ceremony and toasts/speeches to third-party video services, but cannot, for proprietary and intellectual property reasons, provide audio at any other time. • The Client will receive high-resolution media files six (6) months from the date of the event. The completion period is only an approximate length of time. Longer periods may be necessary for completion and will not void this contract. • Lovesick will make exceptional effort to produce a finished product of excellent quality, but cannot make guarantees, neither expressed nor implied, in regard to subjective aesthetic qualities of the completed project. • Lovesick will retain Dropbox links for both the Client’s media files for three (3) months from delivery date, after which time said links will expire. Lovesick will retain digital hard copies of media files for one (1) year from delivery date after which time the digital copies will be deleted. Therefore, we strongly encourage the Client to make copies of photos and/or films and to store those copies securely. • It is understood that Lovesick cannot guarantee to produce any images of any specific objects, situations, persons, or events, or in combination thereof. • The Client will receive high-resolution media files six (6) months from the date of the event. Therefore, we strongly encourage the Client to make copies of photos and/or films and to store those copies securely. • It is understood that Lovesick cannot guarantee to produce any video product of any specific objects, situations, persons, or events, or in combination thereof. • All images are the copyrighted property of Lovesick. • The Client will use its best efforts to advise its guests to exercise due care at the Event, since sensitive and expensive electronic equipment will be in use for providing music services at the Event. • The Client shall be liable for any and al costs, resulting from an "insufficient funds" check. • Events held at outside of Lovesick's travel area of the Philadelphia-metro area and New Jersey will be subject to travel fees. • The Client hereby agrees to provide Lovesick with one night/one room of accommodations at the nearest hotel in the event of severe weather or impassable travel on the date of the Event. The need for and location of accommodations will be determined by Lovesick at the time of the event, however Lovesick will make best efforts to travel home after the Event • The Client is responsible for contacting Lovesick with confirmation of final event details seven (7) to thirty (30) days prior to the event date. • This Agreement may be cancelled by Lovesick as a result of unusually severe weather, natural disasters, governmental actions, acts of God or other circumstances beyond the control of Lovesick, including but not limited to the illness or incapacity of one of its principals, which would make it impossible for Lovesick to fulfill its obligations hereunder. In the event of such an occurrence, Lovesick agrees to promptly notify Client and to use its best efforts to secure a replacement for the Event. • It is the sole responsibility of the Client to inform Lovesick of any specific needs or changes in event or event timeline. • It is the Client’s responsibility to secure permission from all event location officials to shoot the ceremony and negotiate any modifications to their regulations. Lovesick will abide by the site’s rules regarding camera placement at the ceremony.
